Wanderlei Silva’s fate back in the hands of NAC later this month

It’s been turbulent couple of years for Wanderlei Silva, but he might finally get a bit more clarity on his case later this month. On October 29th, Silva will be back in front of NAC so they can “impose new discipline” after his lifetime ban was thrown out, according to what Silva’s attorney Ross Goodman told MMA Junkie.

The Nevada Athletic Commission ruled in September 2014 that Silva would receive a lifetime ban for failing to undergo a random drug test in the lead up to his UFC 175 bout with Chael Sonnen. That sentence was overturned by Nevada judge Kerry Earley in May.

Basically, NAC has to come up with a different form of discipline and that has to be in place before Silva can file his appeal in Nevada Supreme Court, which is based on the idea that he wasn’t licensed at the time of the test and that the commission lacked jurisdiction to perform it.

Silva won’t be at the hearing, according to Goodman:

“I’m not going to have him show up, because our whole position is that they don’t have jurisdiction over him anyway. I’m not going to do a Nick Diaz. There’s nothing to gain.”

Silva (35-12-1, 5-7 UFC) hasn’t fought since he knocked out Brian Stann in March 2013.
